Fencing Waiver and Release
By participating in the fencing activities of Elite Fencers Club, LLC located at 17 Watchung Avenue, Chatham, New Jersey 07928 (hereinafter "EFC"), I agree to abide by the rules of EFC as promulgated from time to time. I acknowledge and agree that I participate in fencing activities at my own risk and hereby release the following from any and all claims and/or liability in any way related to or arising out of EFC to the fullest extent allowed by law: Elite Fencers Club, its members, managers, directors, officers, employees, agents, successors, subsidiaries, parents and other affiliates, if any (hereinafter, the "Released Parties").
I acknowledge and agree that my participation is voluntary and at my own risk. I voluntarily assume all risks of loss, damage or injury that may be sustained while participating in the activities of EFC. I attest that I am physically and mentally fit to participate in the art and activity of fencing.
I understand and agree that any medical or other services rendered to me by, or at the instance of, any of the Released Parties is not an admission of liability to provide, nor to continue to provide, any such services, and is not a waiver by any of the Released Parties of any right hereunder.
I further understand that serious accidents can occur during fencing, and that participants can sustain serious personal injuries and/or property damage as a consequence thereof. Understanding the risks of fencing, I hereby agree to assume those risks and to release and hold harmless the Released Parties who, through negligence or carelessness or otherwise, might be liable to me (or to my heirs, personal representatives or assigns) for damages.
I agree to accept and abide by the rules of EFC. I agree to conduct myself in a courteous manner while I participate in the activities of EFC. I agree to treat EFC employees, members, clients and fencers with respect and to observe proper fencing etiquette while on the fencing strip during training, lessons, and/or competitions.
I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND THE RELEASED PARTIES, AND I HAVE SIGNED IT VOLUNTARILY. If the applicant is under eighteen (18) years of age, the signature of a parent or guardian of the applicant is required.
